The Lombardy Regional Administrative Court (TAR) has rejected an urgent request to suspend the effects of the Milan City Council`s resolution concerning the sale. This request was lodged by the “Gruppo Verde San Siro” association and over a hundred local residents, who had previously filed an appeal to prevent the demolition of the Meazza stadium.

The TAR has scheduled the hearing for November 11, a critical date as it falls the day after the potential enforcement of a Superintendency restriction on the stadium`s second tier. If San Siro were to remain public property beyond this date, its demolition would become impossible. The court`s decision thus allows the sale to be completed within the tight timeframe before such a restriction could take effect. It is widely known that the demolition of most of the current stadium (with the exception of a small part) is a crucial condition set by both clubs for their new project.
In its reasoning, the TAR stated that “contrary to what was argued in the urgent monocratic precautionary measure contained in the additional grounds, there is no extreme gravity and urgency of prejudice,” which would justify an immediate suspension pending a collegiate review. Furthermore, the judges added that “from the imminent effectiveness of the challenged council resolution and the potential signing of the sales contract, no actual prejudice is discernible concerning the specific interests of the appellants, who claim to suffer damages from urban and building transformations and the commencement of works that are not immediately actionable.”
